Wage and Hour Law

ERISA and Disability Policies

Long-term disability policies are classified into two broad groups. The first group is employer-provided plans and the second is individually purchased policies. Employers’ plans generally fall under federal legislation that strictly lays out limited remedies. You’ll need a lawyer who is familiar with the relief allowed by the federal ERISA law as well as someone experienced in appearing before a federal judge, as ERISA disability claims are litigated in U.S. District Court. Individual policies are generally purchased by those who are self-employed. Physicians, lawyers, and other highly paid business owners or consultants pay huge premiums to guarantee their income, should they become disabled. Insurance companies hate to pay out claims, period. But it is even more difficult for people with high incomes to receive the compensation due them.
